Terms of Service

These Terms of Service ("Terms") govern your use of TariffGuard, operated by Desert Oasis Digital LLC ("TariffGuard", "we", "us"). By creating an account or using the Service, you agree to these Terms on behalf of your organization.

1. The Service

TariffGuard provides tariff exposure calculations, alternative supplier matching, and related reporting for critical mineral and capital construction procurement. The Service is intended for business use by authorized representatives of your organization.

2. Your data and security

You retain all rights to the procurement data you submit. We store it with AES-256 encryption at rest and TLS 1.3 in transit, isolate each company's data using row-level security, and never use your data to train any AI model or sell or share it with third parties. 3. Informational use only — limitation of liability

TariffGuard provides informational tariff data, estimates, AI-generated narratives, and supplier recommendations only. The Service does not constitute legal, financial, customs, tax, or procurement advice, and must not be relied upon as a substitute for professional advice or official US Customs and Border Protection rulings.

To the maximum extent permitted by law, TariffGuard and Desert Oasis Digital LLC are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or business, arising from your use of or reliance on the Service. Our total aggregate liability shall not exceed the fees you paid to us in the twelve months preceding the claim.

4. Acceptable use

You agree not to misuse the Service, attempt to access other customers' data, reverse engineer the Service, or use it in violation of applicable laws, including export-control and sanctions laws.

5. Subscriptions and billing

Paid plans are billed in advance on a recurring basis and may be canceled at any time; access continues through the end of the paid period. Enterprise terms may be set out in a separate order form.

6. Termination

You may stop using the Service at any time and request deletion of your data. We may suspend or terminate access for violation of these Terms.

7. Governing law

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law principles, and the state and federal courts located in Washington shall have exclusive jurisdiction.
